By visiting our website, creating an account or placing an order, you agree to these Terms of Service, along with our Return & Refund Policy, Shipping Policy and Privacy Policy, which form part of these Terms. Please read them carefully before using the website.  if you do not agree with any part, please do not use the website or place an order.

General conditions

• We may refuse service to anyone, for any lawful reason, at any time.
• Your card and UPI payment details are always encrypted and handled directly by our secure payment gateway.
• You may not copy, reproduce, resell or commercially use any part of this website, its product photos or its content without our written permission.
• Section headings in these Terms are for convenience only and do not change the meaning of any section.

In these Terms, “5MA Fashions”, “we”, “us” and “our” refer to 5MA Fashions (a unit of Shifa Traders). “You” and “your” refer to anyone who visits the website or buys from us.

These Terms apply to every visitor and customer. Any new feature, product range or service we add to the website will also be covered by these Terms. The latest version is always available on this page.

Eligibility and use of the website

• You must be at least 18 years old to place an order. Our kids’ and newborn range is sold to adults buying for children.
• You agree to use the website only for lawful purposes and in line with these Terms.
• You must not attempt to damage, disrupt or gain unauthorised access to the website, or upload any virus or harmful code.
• If you break any of these Terms, we may suspend or cancel your access and any pending orders.

Products, colours and sizing

• Our products are made in small batches, so designs, prints and stock change often. A product shown on the website may sell out before your order is confirmed.
• We try to show product colours and prints as accurately as possible. Actual colours may look slightly different because of lighting during photography and your screen settings. This is not treated as a defect.
• Each product page includes a size guide. Please check your size before ordering.
• Fabric details differ between products. Please read each product description for the exact fabric and care instructions.
• Our maternity and feeding wear is designed for comfort during pregnancy and after delivery. It is clothing, not a medical product.

Prices and offers

• All prices are shown in Indian Rupees (₹).
• Delivery charges and any discounts are shown at checkout before you pay.
• Prices, offers and discounts may change at any time without notice. The price that applies is the one shown when you place your order.
• Offers and coupon codes cannot be combined unless clearly stated, have no cash value, and may be withdrawn at any time.
• Free shipping applies to orders of ₹3,000 and above, unless an offer states otherwise.

Placing and accepting orders

• An order is confirmed only after payment is successful. All website orders are prepaid.
• You will receive an invoice by email after placing a website order.
• We may limit quantities, or decline an order, including orders that appear to be placed by resellers, orders with incorrect pricing, or orders that look fraudulent. Where we are unable to fulfil a prepaid order, we will work with you to arrange a suitable resolution in line with our Return & Refund Policy.
• You agree to give us complete and accurate details, including your name, delivery address, pin code, mobile number and email address.

Order cancellation

• Orders cannot be cancelled. The website does not offer order cancellation, and once an order is placed it cannot be cancelled by you or by us.
• We do not offer cash refunds, bank refunds or refunds in any other form. For items that are damaged, defective or wrongly delivered, we offer an exchange only, as set out in our Return & Refund Policy.
• To raise an exchange, message us on WhatsApp at +916369712357 or email us within 3 days of delivery. A continuous, unedited unboxing video is mandatory for any damage, defect or missing-item claim.

Payments

• Website orders are prepaid. We accept UPI (Google Pay, PhonePe and other UPI apps) and debit and credit cards through our secure payment gateway.
• We do not see or store your full card number or UPI PIN.
• If a payment fails but money is debited from your account, it is usually reversed automatically by your bank or the payment gateway within their standard timelines.

Shipping and delivery

• Orders are usually dispatched within 24 hours on working days.
• Estimated delivery: 1 to 3 working days within Tamil Nadu and Pondicherry, and 3 to 5 working days for other states.
• There is no courier pickup or delivery on Sundays.
• Delivery times are estimates. Delays caused by the courier, weather, holidays, strikes or other events outside our control are not our responsibility, but we will help you follow up with the courier.
• We deliver to all serviceable pin codes in India. If your pin code is not served, we will contact you within one working day.

Exchanges, returns and refunds

• We offer an exchange only for items that are damaged, defective or wrongly delivered.
• Exchange requests must be raised within 3 days of delivery by WhatsApp or email.
• A continuous unboxing video, with no cuts or edits, is mandatory for any damage, defect or missing item claim.
• Items must be unused, unwashed, free of odours and in their original condition, and must pass our quality check.
• We do not offer cash refunds, bank refunds or refunds in any other form. Only an exchange will be provided, and only if the conditions above are met.

Your account

• You are responsible for keeping your account login details confidential and for all activity under your account.
• Please tell us immediately if you believe your account has been used without your permission.
• We may suspend or close accounts that break these Terms.

Reviews, photos and other submissions

• If you send us reviews, feedback, suggestions, photos or videos, you allow us to use, edit, publish and share them on our website, social media and marketing, without payment.
• If you do not want a submission to be used publicly, please tell us when you send it.
• You agree that anything you submit is your own, is honest, and does not contain anything unlawful, abusive, obscene or misleading.

Intellectual property

• The 5MA Fashions name, logo, product designs, prints, photos, videos, text and all other website content belong to 5MA Fashions (a unit of Shifa Traders) or are used with permission.
• You may not copy, reuse, resell or reproduce any of this content, or use our product photos to sell products elsewhere, without our written permission.

Third-party services and links

• To run this website, we use trusted third-party services, including a payment gateway, courier partners, email and messaging services, and website analytics.
• Our website may link to third-party websites and apps, such as WhatsApp, Instagram, Facebook and courier tracking pages. We do not control these websites and are not responsible for their content.

Your personal information is handled as described in our Privacy Policy. By using the website, you agree to the collection and use of your information as set out there.

Errors and inaccuracies

• Sometimes the website may contain errors in product descriptions, prices, offers, delivery charges, delivery times or stock availability.
• We may correct any error and update information at any time without notice. If an order was placed at an incorrect price or for an item that is unavailable, we may cancel it and resolve it in line with our Return & Refund Policy.

Disclaimer and limitation of liability

Indemnity

If any part of these Terms is found to be unlawful or unenforceable, that part will be applied to the fullest extent allowed by law, and the rest of these Terms will remain in full effect.

Termination

• These Terms apply until ended by you or by us. You may stop using the website at any time.
• We may end these Terms or restrict your access at any time if we believe you have broken them.
• Any order placed, amount due or obligation that existed before termination will still apply.

Entire agreement

• These Terms, together with our Return & Refund Policy, Shipping Policy, Privacy Policy and any other policy posted on this website, form the full agreement between you and 5MA Fashions and replace any earlier versions.
• If we do not enforce any part of these Terms at a particular time, it does not mean we have given up that right.

Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Chennai, Tamil Nadu.
